Jin 0 Nahlásit příspěvěk Odesláno July 30, 2004 The Situation In July 1998, IBM East Europe/Asia, pleaded guilty to charges that it exported a total of 17 computers to Arzamas-16, a Russian nuclear weapons laboratory. The laboratory purchased the computers to perform "research on, or development, design, manufacture, construction, testing, or maintenance of nuclear weapons." The U.S. government case stated that IBM should have had "reason to believe" that their computers would be used for proliferation purposes. The Consequences IBM East Europe/Asia was forced to pay a U.S. $8.5 million criminal fine, and was placed on probation for a period of two years. The subsidiary was required to apply for an export license for nearly all of its computer shipments to Russia for the duration of its probation. Had it violated any U.S. export control regulation during this period, the subsidiary would have lost its U.S. export and reexport privileges. This case also resulted in extensive negative news coverage and permanent Congressional involvement in the setting of export control levels for computer systems. The Situation In January 2003, Silicon Graphics (SGI) pled guilty to two criminal charges that it had violated U.S. export control regulations by illegally exporting high-performance computers to a Russian nuclear laboratory in 1996. SGI admitted that on two separate occasions it had exported four Challenge L computer systems, upgrades, and peripheral equipment to the All-Russian Institute for Technical Physics (Chelyabinsk-70, a Russian nuclear weapons facility) in violation of the U. S. export control regulations. The Consequences SGI was forced to pay a U.S. $1 million criminal fine for exports to the Russian nuclear facility. SGI was fined an additional U.S. $182,000 to settle civil charges for exports to the same lab In addition to these fines, SGI was placed on probation for three years.
